Appeals Board
About
The purpose of the DMV Appeals Board is to review and evaluate all hearing officer determinations duly appealed under VTL §228; 15 NYCRR 155.1. The Appeals Board may affirm, reverse, or modify the initial determination of the hearing officer.
Proceedings
The Appeals Board consists of a rotating panel of board members. Under NY VTL 228(1): "Any appeals officer who is not a full-time employee of the department shall receive a per diem at a rate to be fixed by the commissioner, with the approval of the director of the budget, for each day [they serve] on an appeals board, in addition to all necessary expenses."
The Appeals Board exists within the interests of the Open Meetings Law and the Personal Privacy Protection Act. The Appeals Board meets every Thursday to decide the Traffic Violations Bureau (TVB) and the last Tuesday of the month to decide Administrative Appeals Board (AAB) appeals.

Member Backgrounds
Tanya L. Davis is a DMV Associate Attorney and Former Town Justice.
Cory Haines is a Senior Attorney working with the Appeals Board since 2001.
Matthew McNamara is a trial lawyer with a practice devoted to the defense of complex and high-exposure litigation. His expertise is in medical malpractice, product liability, and insurance defense. He practices in New York State and Massachusetts.
Laurence Naviasky is a private practice attorney with extensive experience in transactional, vehicular, and municipal law.
Kathryn Lamont Teal is a private practice attorney with extensive experience in estate planning and transactional law. She is also a former clerk to the Appellate Division, Third Department.
David T. Weber is a private-sector solo practitioner specializing in real estate, trusts & estates, family, educational, and municipal law.
Stanley Zalen was an attorney at the NYS Board of Elections for 37 years, ending his tenure as Democratic Executive Director. He acted as counsel to Board of Elections board members as well as a BOE hearing officer.
