Requirements and forms for driver education providers

 

As permitted under §383.75 of the Federal Motor Carrier Safety Administration’s (FMCSA) regulations, and §502(4)(b) of the New York State Vehicle and Traffic Law, the New York State Department of Motor Vehicles (DMV) intends to receive comments in regard to allowing Third-Party Road Testing of Commercial Driver License (CDL) applicants to expand the availability of such testing and reduce the time needed to get licensed CDL drivers on the road. 


DMV will hold a public hearing on May 7, 2018 from 1:30 pm to 3:30 pm to hear comments on this initiative.  The hearing will be held in Room 137 at NYS DMV’s main office, located at 6 Empire State Plaza, South Swan Street, Albany, NY 12228.  Written comments may be mailed to the address below, or submitted by email to: [email protected] and must be received by 3:30 pm on May 7, 2018, to be considered.

The Driver Education Program is jointly administered by the Department of Motor Vehicles (DMV) and the State Education Department (SED).

The Driver and Traffic Safety Education Course is designed for new drivers (as defined in Part 2 of the Commissioner's Regulations (PDF) ) and is offered only through high schools and colleges. The course is conducted under the State Education Department’s (SED) procedures and guidelines. Courses must provide each student at least twenty-four (24) clock hours of classroom instruction and twenty-four (24) clock hours of in-car instruction. Students must complete at least six (6) clock hours of actual behind-the-wheel driving and eighteen (18) clock hours of observation in a teacher-supervised vehicle.

Students enrolled in the approved Driver and Traffic Safety Education Course are eligible to receive a Pre-licensing Course Completion Certificate (MV-278)(see Part 2 of the Commissioner’s Rules and Regulations (PDF)), if the required content of the DMV approved Pre-licensing Program has been presented (i.e., the 4 to 5 hours of educational instruction that includes the required component on the subject of alcohol and drugs). This can be part of an existing curriculum or as a separate offering. The Pre-licensing Course Instructor's Manual (PDF)  (MV-277) may be used as a guide for the required content for the course. The Pre-licensing Course Student's Manual (PDF) (MV-277.1) is available for student use.

A Driver Education Teacher Certificate (MV-283) allows the teacher to teach the DMV approved Pre-licensing Course at a high school or college on behalf of that school. The Bureau of Driver Training Programs (DTP) issues the Driver Education Teacher Certificate upon request from SED if the applicant has a satisfactory driver record history.  If the applicant does not have a satisfactory record, DTP notifies SED. SED determines if the application will be denied. The course instructor must carry their Driver Education Teacher Certificate (MV-283) during any behind-the-wheel instruction.

To receive approval to issue Pre-licensing Course Completion Certificates (MV-278), the school must send a completed Authorization and Approval for Pre-Licensing Course (PDF) form (MV-278.7) to the Utica Processing Center.  To order Pre-licensing Course Completion Certificates (MV-278), the school must send a completed MV-278/Pre-Licensing Course Completion Certificate Order Form for Secondary Schools And College (PDF) (MV-278.8 SSC) to the Utica Processing Center.  The Utica Processing Center will provide the school with completion certificates for both the Pre-licensing Course and the Driver Ed Course.
