The DMV accepts in-person personal service of legal documents at the public entrance between cores 3 and 4, Monday - Friday between the hours of 9:30 a.m. – 3:30 p.m. This includes, but is not limited to, summons and complaints, Article 78 proceedings, mortgage foreclosures, tax foreclosures, claims against the state, service of process and personal delivery.
Service of a subpoena on DMV may be made in the following ways:

Subpoenas the DMV Will Honor
The DMV will honor a subpoena if it is
- a subpoena ordered by a New York State judge
- an administrative subpoena from a government agency in New York State (the subpoena must cite the statutory authority that grants subpoena power to the agency)
- a subpoena ordered by a federal court
Records for which a subpoena is required
A subpoena is required for the following DMV records
- driver license photos
- a record that contains unmasked, highly-sensitive information, such as a social security number
- any record that is defined by statute as not a public record.
Out-of-State Subpoenas
The DMV will not honor any out-of-state subpoena unless a New York State judge has ordered that the DMV comply with the subpoena.
