While most IDP participants are NY State licensed drivers wishing to enroll in NY State IDP programs, New York State provides a number of alternatives depending on your circumstances. Please review the following chart for a situation which will meet your needs.
State of License | State of Conviction | Desired IDP Location | What to do |
---|---|---|---|
NY or Out-of-State | NY | Out-of-state | A Request for Approval of Out-of-State Impaired Driver Program [1] (DS-1) must be completed by a qualifying out-of-state provider.
|
NY | Out-of-state | NY | Once the conviction has been entered on your NY State driving record, you will be mailed a suspension or revocation order with information about the IDP and conditional license options. If you have not received an order of suspension or revocation, DMV may not have been notified of your out-of-state conviction. Contact the convicting court about sending your out-of-state conviction to the NY State DMV |
Out-of-state | NY | NY | Once the conviction has been entered on your NY State driving record, you will be mailed a suspension or revocation order with information about the IDP and conditional license options. If eligible for the IDP, you must go to a NY State or county motor vehicle office to enroll. At enrollment, you must provide your driving record (abstract) from your home state before the DMV can issue a conditional driving privilege. The abstract must have been issued within the previous 30 and reflect that your license is valid.

Out-of-state | Out-of-state | NY | This is called a “courtesy” IDP enrollment. Enrollments of this type are processed directly through the IDP and do not require the assistance of NY State DMV. For a list of IDPs available in your area, see “Find IDPs by county [3]”. Please note: before enrolling in a program, you must check with the state in which you are licensed to be sure the program will satisfy that state’s requirements. |
